01 Acceptance of these terms

These Terms of Use govern your access to and use of this website, operated by Roots Dental (“Roots Dental,” “we,” “us,” or “our”), a dental practice located at 184 Pompton Ave, Verona, NJ 07044.

By visiting this site, submitting a form, calling the number shown here, or exchanging text messages with us, you agree to these terms and to our Privacy Policy. If you do not agree, do not use the site.

02 Emergency and medical disclaimer

Descriptions of conditions, procedures, and timelines on this site are general information only. Whether a particular treatment is right for you depends on your examination, your imaging, and your medical history. Never disregard professional advice or delay seeking care because of something you read here.

03 Who may use this site

This site is intended for people aged 18 and over who are located in the United States. If you are under 18, a parent or legal guardian must submit any request on your behalf. By using the site you confirm that the information you give us is accurate, that it is yours to give, and that you are authorized to give any consent you provide, including consent to be contacted at the phone number you supply.

04 Permitted and prohibited use

You may use this site to learn about our practice, to find our location and hours, and to request an appointment. You may not:

• Submit false, misleading, or someone else's contact details, including a phone number you are not authorized to use.
• Use the site for any unlawful purpose, or in a way that could damage, disable, or overburden it.
• Attempt to gain unauthorized access to any part of the site, its servers, or connected systems.
• Use automated systems, scrapers, or bots to collect content or contact details from the site.
• Copy, reproduce, or redistribute any part of the site except as allowed under section 09.
• Send us abusive, threatening, or harassing messages through any channel.

We may suspend or block access to the site, or stop responding to messages, if we believe these terms have been breached.

05 Appointment requests

Submitting a request through this site or leaving a message does not book an appointment. An appointment is confirmed only when a member of our team confirms it with you directly. Availability, including same-day emergency availability, depends on the day and the nature of the problem, and we will tell you honestly when we can see you.

Please do not include detailed clinical information, images of injuries, or insurance identifiers in a web form or a text message. Bring that information with you or share it over the phone.

06 SMS and text messaging program terms

These terms apply to the Roots Dental text messaging program. They form part of your agreement with us and are consistent with our Privacy Policy.

Program description

Roots Dental sends conversational replies, appointment confirmations and reminders, treatment follow-up instructions, and account or billing notices by text message to patients and to people who have asked us to contact them.

Consent

You are enrolled only when you affirmatively give us your mobile number and agree to be contacted, by checking a consent box on a form on this site, by giving your number on a patient intake form that includes messaging consent language, or by texting us first. Consent to receive text messages is not a condition of purchasing any product or of receiving any dental service. You confirm that you are the subscriber or the customary user of the number you give us, and that you will tell us if the number changes.

Message frequency

Message frequency varies. Conversational replies depend on your exchange with us. Appointment and care messages are typically a few messages per appointment.

Cost

Message and data rates may apply. Charges depend on your mobile plan and are billed by your carrier. Roots Dental does not charge for the messages themselves.

Opting out

Reply STOP to any message to cancel. You will receive one final message confirming that you have been unsubscribed, after which no further texts will be sent. To rejoin, sign up again or reply START.

Reply HELP to any message, or call us at (973) 779-3771 during opening hours.

Carriers and delivery

Delivery is not guaranteed, and messages may be delayed or fail for reasons outside our control. Carriers are not liable for delayed or undelivered messages. Supported carriers may change without notice.

Not for emergencies

Do not use text messaging to report an emergency. Messages are monitored during opening hours only. In an emergency call us, or call 911 if the situation is life-threatening.

07 Telephone contact consent

By giving us your telephone number, you agree that Roots Dental and the service providers acting on our behalf may contact you at that number about your care, your appointments, and your account, including by automated dialing or prerecorded message where permitted by law. Consent is not a condition of receiving treatment. You may withdraw it at any time by telling us on a call, replying STOP to a text, or contacting us using the details in section 17.

Calls to and from our office may be recorded or monitored for quality assurance and training. You will be notified at the start of a recorded call and may ask us not to record.

08 Privacy

Our Privacy Policy explains what we collect, how we use it, and the choices you have. It is incorporated into these terms by reference. Protected health information held as part of your dental record is additionally governed by HIPAA and by our Notice of Privacy Practices, available at our office.

09 Intellectual property

The content of this site, including text, layout, graphics, photographs, logos, and the Roots Dental name and marks, is owned by Roots Dental or its licensors and is protected by copyright and trademark law. You may view and print pages for your own personal, non-commercial use. Any other use, including copying, republishing, framing, or using content to train an automated system, requires our written permission.

If you believe content on this site infringes your copyright, contact us using the details in section 17 with a description of the work, the location of the material, and your contact information.

10 Reviews, testimonials and results

Patient reviews shown on this site are the opinions of the individuals who wrote them and are reproduced as published on the relevant platform. Photographs of patients and any before-and-after images represent individual cases and are used with permission.

Results vary from person to person. No treatment outcome, healing time, or level of comfort is promised or guaranteed, and not every treatment is suitable for every patient. What is right for you will be discussed with you after an examination.

11 Third-party links and services

This site links to and embeds services operated by others, including map services and review platforms. We do not control those services, do not endorse their content, and are not responsible for their availability, accuracy, or privacy practices. Your use of a third-party service is governed by that provider's own terms.

12 Disclaimer of warranties

This site is provided on an “as is” and “as available” basis. To the fullest extent permitted by law, Roots Dental disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

We do not warrant that the site will be uninterrupted, timely, secure, or error free, that defects will be corrected, or that the site or its servers are free of harmful components. Information on this site may become out of date, and we are under no obligation to update it.

13 Limitation of liability

To the fullest extent permitted by law, Roots Dental and its owners, doctors, employees, and service providers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, or loss of goodwill, arising out of or connected with your use of this site, whether based in contract, tort, negligence, strict liability, or any other theory, even if we have been advised of the possibility of those damages.

Our total liability for any claim arising out of or relating to this site is limited to one hundred United States dollars (US $100.00).

14 Indemnification

You agree to indemnify and hold harmless Roots Dental and its owners, doctors, employees, and service providers from any claim, demand, loss, liability, or expense, including reasonable legal fees, arising out of your use of this site, your breach of these terms, your violation of any law, or your submission of a phone number or other information you were not authorized to provide.

15 Governing law and disputes

These terms are governed by the laws of the State of New Jersey, without regard to its conflict of law rules. Any dispute arising out of or relating to this site or these terms will be brought exclusively in the state or federal courts located in Essex County, New Jersey, and you consent to the jurisdiction of those courts.

If any provision of these terms is found unenforceable, that provision will be limited or removed to the minimum extent necessary and the remaining provisions will stay in full force. Our failure to enforce a provision is not a waiver of it.

16 Changes to these terms

We may revise these terms at any time. The “last updated” date at the top of the page shows when the current version took effect. Changes apply from the moment they are posted, and your continued use of the site means you accept them. If you do not agree with a change, stop using the site.
